These terms of use ("Terms") apply to the use of the mobile application DupSweep ("the App"), provided by Kali Yuga B.V., registered in Zwolle, Chamber of Commerce no. 42134294 ("the Provider", "we", "us"). By installing, opening or using the App you agree to these Terms. If you do not agree, do not use the App.
1.1. The App helps you clean up your own photo library. It detects identical copies and series of highly similar photos and suggests which photo you might keep.
1.2. The App is a tool. All analysis, grouping and suggestions are automated and indicative. The App never decides on its own to delete anything.
2.1. Deletion only happens after you instruct it and after iOS asks you to confirm. You are and remain fully responsible for the choice of which photos or videos are deleted.
2.2. The App's suggestions may be incorrect or incomplete. Always check the selection yourself before you confirm.
2.3. iOS moves deleted items to "Recently Deleted", where they can be recovered for about 30 days. It is your responsibility to check within that period and to keep your own backups.
2.4. We strongly advise making a recent backup of your photo library before use.
3.1. The App is provided "as is" and "as available", without any warranty to the extent permitted by law.
4.1. To the extent permitted by law, we are not liable for any damage arising from or related to the use of the App, expressly including the — whether or not unintended — deletion, loss or alteration of photos, videos or other data.
4.2. We are not liable for indirect or consequential damage, lost profits or data loss.
4.3. If we were nonetheless liable, our total liability is limited to the amount you paid for the App.
4.4. These limitations do not apply to damage from our intent or wilful recklessness, nor where mandatory consumer law provides otherwise. Nothing here limits your mandatory consumer rights.
5.1. The App offers a one-time purchase to unlock all features. Payments and refunds are processed by Apple via the App Store.
6.1. Analysis happens entirely on your device. We do not collect or upload your photos. See our privacy policy.
7.1. These Terms are governed by the laws of the Netherlands, without prejudice to mandatory rules that protect you as a consumer. Contact: info@kaliyuga-apps.nl.

Deze gebruiksvoorwaarden ("Voorwaarden") zijn van toepassing op het gebruik van de mobiele applicatie DupSweep ("de App"), aangeboden door Kali Yuga B.V., gevestigd te Zwolle, KvK 42134294 ("de Aanbieder", "wij", "ons"). Door de App te installeren, te openen of te gebruiken ga je akkoord met deze Voorwaarden.
1.1. De App helpt je je eigen fotobibliotheek op te schonen en doet een suggestie welke foto je zou kunnen bewaren.
1.2. De App is een hulpmiddel. Alle suggesties zijn geautomatiseerd en indicatief. De App verwijdert nooit zelfstandig iets.
2.1. Verwijderen gebeurt pas nadat jij opdracht geeft en iOS om bevestiging vraagt. Jij bent volledig verantwoordelijk voor welke foto's of video's worden verwijderd.
2.2. De suggesties kunnen onjuist of onvolledig zijn. Controleer altijd zelf de selectie.
2.3. iOS verplaatst verwijderde items naar 'Recent verwijderd', waar ze ongeveer 30 dagen herstelbaar zijn. Zorg zelf voor back-ups.
2.4. Maak vóór gebruik een recente back-up van je fotobibliotheek.
3.1. De App wordt geleverd "zoals deze is", zonder enige garantie voor zover wettelijk toegestaan.
4.1. Voor zover wettelijk toegestaan zijn wij niet aansprakelijk voor schade die voortvloeit uit het gebruik van de App, uitdrukkelijk inbegrepen het — al dan niet onbedoeld — verwijderen, verliezen of wijzigen van foto's, video's of andere gegevens.
4.2. Wij zijn niet aansprakelijk voor indirecte schade, gevolgschade of schade door dataverlies.
4.3. Mochten wij toch aansprakelijk zijn, dan is onze totale aansprakelijkheid beperkt tot het bedrag dat je voor de App hebt betaald.
4.4. Deze beperkingen gelden niet bij opzet of bewuste roekeloosheid, noch voor zover dwingend consumentenrecht anders bepaalt. Niets hierin beperkt je dwingendrechtelijke consumentenrechten.
5.1. De App kent een eenmalige aankoop om alle functies te ontgrendelen. Betalingen en restituties verlopen via Apple.
6.1. De analyse gebeurt volledig op je toestel. Wij verzamelen of uploaden je foto's niet. Zie ons privacybeleid.
7.1. Op deze Voorwaarden is Nederlands recht van toepassing, onverminderd dwingende regels die jou als consument beschermen. Contact: info@kaliyuga-apps.nl.
